Terms of Service - All Island Pickup

Please read these Terms of Service ("Terms") carefully before using the garbage service provided by “All Island Pickup”. These Terms outline the terms and conditions governing the use of our garbage service and form a legally binding agreement between “All Island Pickup” ("We," "Us," or "Our") and the user ("You" or "Your") of our garbage service.
Acceptance of Terms By using our garbage service, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree to these Terms, you may not use our garbage service.
Description of Service: Our garbage service involves the collection, and management of waste materials from residential or commercial properties. We offer various garbage collection plans and schedules based on your needs, as outlined in our service agreement.
Service Agreement: When you engage our garbage service, you will be required to sign a separate service agreement that details the specific terms, pricing, and duration of our service. The service agreement shall prevail in case of any conflict or inconsistency with these Terms.
Payment and Billing (A.) Fees: You agree to pay all applicable fees and charges associated with our garbage service, as outlined in the service agreement or as communicated to you by our billing department. (B.) Billing Cycle: Unless otherwise specified in the service agreement, our garbage service fees will be billed on a weekly/monthly/quarterly/annual basis. You are responsible for the timely payment of invoices. (C.) Late Payments: Failure to make timely payments may result in the suspension or termination of our garbage service. Late payment fees and interest charges may be applied. (D.) Disputed Charges: If you believe there is an error in your invoice, you must notify us within 15 days of the invoice date. Failure to notify us within this period will deem the invoice as accurate and binding.
Service Limitations and Liability (A.) Safety: We will provide garbage collection services to the best of our abilities, prioritizing safety for both our employees and customers. However, we cannot be held responsible for accidents, damages, or injuries resulting from unsafe conditions or negligence on your property. (B.) Waste Classification: You are responsible for ensuring that the waste materials placed for collection comply with all applicable laws, regulations, and waste classification guidelines. We reserve the right to refuse collection of hazardous, prohibited, or non-compliant waste. (C.) Property Access: You agree to provide unobstructed access to your property on the scheduled collection day. Failure to do so may result in missed collection, and we will not be liable for any inconvenience or additional fees incurred as a result. (D.) Service Interruptions: While we strive to provide continuous garbage service, there may be instances of service interruptions due to factors beyond our control, such as weather conditions or equipment failures. We will make reasonable efforts to notify you of any planned or unplanned interruptions. (E.) Limitation of Liability: In no event shall “All Island Pickup” be liable for any direct, indirect, incidental, consequential, or special damages arising from or related to our garbage service, including but not limited to property damage, personal injury, or loss of business.
Termination (A.) You may terminate our garbage service by providing written notice within the terms specified in the service agreement. (B.) We reserve the right to terminate our garbage service, with or without cause, upon providing written notice to you within the terms specified in the service agreement. (C.) Upon termination, you are responsible for settling any outstanding balances, and we may arrange for the final collection of waste materials.
Intellectual Property: All intellectual property rights related to our garbage service, including but not limited to trademarks, service marks, logos, and content, are the property of All Island Pickup. You may not use, reproduce, or distribute any intellectual property without our prior written consent.
Amendments to the Terms: We reserve the right to modify or amend these Terms at any time. Any changes will be effective upon posting the updated Terms on our website. It is your responsibility to review these Terms periodically.
Governing Law and Dispute Resolution: These Terms shall be governed by and construed in accordance with the laws of New York. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in New York.
